Booking & Event Policies
1) Definitions
1.1 “6th Note” / “We/Us/Our”: The mobile luxury fragrance bar operated by 6th Note.
1.2 “Client/You/Your”: The individual or entity booking services.
1.3 “Event”: The date(s), time(s), and location(s) where services will be performed.
1.4 “Experiences/Services”: Mobile perfumery services, fragrance styling, and related add-ons described in the proposal/invoice.
1.5 “CrystalScent Batons”: 6th Note’s branded scent tester tools and any sampling implements used on site.
1.6 “Quote/Proposal”: Written pricing and inclusions provided by 6th Note, typically with a validity window.
1.7 “Retainer/Deposit”: Non-refundable initial payment to reserve the date and allocate materials.
2) Booking & Payment Terms
2.1 Reservation Requirement. A signed agreement and non-refundable 50% retainer are required to secure the date. Dates are first-come, first-served until both are received.
2.2 Balance Due. Remaining balance is due 7 calendar days before the Event. Services, travel, or setup will not commence until paid in full.
2.3 Accepted Payments & Fees. We accept major credit/debit cards and electronic transfers. Card payments incur a 3–4% processing fee.
2.4 Pricing Scope. All pricing is tailored to guest count, venue, setup complexity, and fragrance design. Quotes specify inclusions, travel, setup, and optional add-ons.
2.5 Quote Validity. Unless otherwise stated, proposals are valid for 14 days. After expiry, pricing and availability may change.
2.6 Minimums & Peak Surcharges. Event minimums and holiday/peak-date surcharges may apply and will be stated on your proposal.
2.7 Changes & Upgrades. Increases to guest count, hours, or add-ons require an updated invoice. All changes must be finalized and paid no later than 72 hours prior to the Event.
2.8 Overage/On-Site Purchases. If you request on-site upgrades (e.g., extra vessels, labels, or time), we may accommodate at our discretion. Payment due immediately on site (card accepted). Overage rates will be listed in your proposal.
2.9 Late Payment. Invoices not paid by the due date may result in suspension/cancellation. A late fee of 2% per month (or the maximum allowed by law) may apply.
2.10 Chargebacks. Client agrees not to file chargebacks for services delivered per agreement. Disputes must be addressed in writing; unjustified chargebacks are subject to collection, recovery of fees, and reasonable attorney’s costs.
2.11 Taxes & Gratuities. Applicable taxes are additional unless stated otherwise. Gratuities are appreciated but not required and are not included unless specified.
2.12 Third-Party Payments. If a sponsor/venue pays on your behalf, you remain responsible for any unpaid amount.
3) Travel & Access
3.1 Base Radius. Standard travel includes up to 15 miles round trip from Roseland, Louisiana. Mileage beyond this is billed at $1.50 per mile round trip unless otherwise noted.
3.2 Overnight/Out-of-Area. Lodging, per-diem, tolls, and parking may apply for distant or multi-day events; details appear on your proposal.
3.3 Parking & Loading. Client must provide nearby parking and safe loading access. Any paid parking/valet fees are billable.
3.4 Stairs/Elevators. If load-in requires stairs or distant access, please inform us in advance; additional setup time/assistants may be required and billed.
4) Venue Requirements & Setup
4.1 Space & Power. Minimum one 6-ft table (or 6th Note’s own bar plus table space) with level surface. Power outlet within 25 ft if needed.
4.2 Environment. Protected from direct sun, high wind, rain, or excessive heat/cold. Indoor or properly tented/covered outdoor space required.
4.3 Ventilation. Adequate ventilation must be provided. We comply with venue policies for alcohol-based perfuming materials.
4.4 Load-In/Out Timing. 60 minutes for setup before guest arrival and 30–45 minutes for breakdown (subject to installation complexity).
4.5 Aesthetic Integrity. Our display is calibrated for guest flow and safety. Please do not rearrange our materials after setup.
4.6 Venue Rules & Permits. Client is responsible for confirming venue rules (e.g., open-table displays, vendor insurance). We maintain general liability coverage; COI available upon request.
4.7 ADA & Safety. Client ensures the site is ADA-compliant, free of hazards, and provides reasonable guest access.
5) Staffing, Throughput & Timing
5.1 Staffing. Standard packages include 1 Lead Scent Curator (and assistants as specified).
5.2 Guest Throughput. Typical throughput is 8–15 guests per hour per active blending station, depending on service style and customizations. Your proposal will indicate the recommended stations/staff for your guest count.
5.3 On-Site Contact. Client must provide a decision-maker (name + mobile) available throughout the Event.
5.4 Delays. If start is delayed due to venue access, weather, late guests, or other issues beyond our control, we will perform to the best of our ability within the original end time. Extending service is subject to availability and billed at the stated overtime rate.
5.5 Overtime. Overtime is billed in 30-minute increments at the rate listed in your proposal/invoice and must be approved and paid before extension.
6) Materials, Customization & IP
6.1 Materials Allocation. Your retainer covers time, preparation, and product allocation. Materials are procured and batched in advance; changes close to the Event may be limited.
6.2 Custom Labels & Collateral. If included, proofs require Client approval by the artwork deadline in your proposal. Post-approval changes may incur reprint fees.
6.3 Ownership of Formulas & IP. All fragrance blends, recipes, tools (including CrystalScent Batons), processes, visual displays, and brand assets remain exclusive intellectual property of 6th Note. Client receives the finished personal product(s) created at the Event, but not the underlying formulas or rights to reproduce.
6.4 Photography & Marketing. We may capture non-identifiable photos/videos of the installation for portfolio/marketing. If you prefer no identifiable guest imagery, notify us in writing at least 72 hours prior to the Event. Corporate NDAs can be accommodated upon request.
7) Health, Safety & Allergies
7.1 Ingredient Standards. We source ingredients from reputable suppliers; selected materials are skin-appropriate and aligned with IFRA best practices for their intended uses.
7.2 Disclosures. Client agrees to notify guests that fragrance compounds may contain allergens (e.g., botanicals, essential oils, aroma molecules, alcohol). Pregnant, nursing, highly sensitive individuals, or those with respiratory/dermatologic conditions should consult a professional before participating.
7.3 Patch Testing. Guests are advised to patch test before full wear; avoid eyes, mucous membranes, open skin, and flames.
7.4 Sanitation. Tools, funnels, and touchpoints are cleaned/sanitized regularly. Single-use disposables are used where appropriate.
7.5 Minors. Participation by minors requires parent/guardian supervision and may be limited to alcohol-free options at our discretion.
7.6 Ventilation & Fire Safety. Alcohol-based products are flammable. No open flames/sparks at or near the station. Venue must permit alcohol-based perfuming materials.
8) Client Responsibilities & Damage
8.1 Site Readiness. Provide timely venue access, table(s), power, lighting, and protection from weather.
8.2 Security. Client ensures reasonable security for the area to prevent tampering, theft, or damage.
8.3 Damage/Loss. Client is responsible for loss or damage to 6th Note property caused by guests, vendors, or venue (including spills on electronics, broken glassware, or missing tools). Replacement at current market cost plus reasonable administrative fee.
9) Cancellation, Reschedule & Force Majeure
9.1 Client Cancellation.
a) ≥15 days before Event: Retainer is non-refundable but transferable once to a new date within 6 months, subject to availability and any price changes.
b) 14–8 days before Event: 75% of total invoice is due/retained to cover allocated materials and labor.
c) ≤7 days before Event or no-show: 100% of the total invoice is due/retained.
9.2 Rescheduling. One complimentary reschedule if requested ≥14 days in advance. Additional changes: $100 reschedule fee. New date must be within 6 months of original.
9.3 Weather & Outdoor Events. Client must provide a weather-safe backup. If conditions are unsafe or unsuitable (wind, rain, extreme heat/cold) and no adequate cover exists, we may decline setup. Fees are not refundable; we will make reasonable efforts to reschedule per §9.2.
9.4 6th Note Cancellation. In rare situations (e.g., emergency, illness, unsafe conditions), Client may select a full refund of monies paid or reschedule at no penalty.
9.5 Force Majeure. Neither party is liable for delays/failures due to events beyond control (acts of God, natural disasters, epidemics, government orders, labor disputes, power failures, etc.). Deposits may be credited toward a future date at 6th Note’s discretion, less unrecoverable costs.
10) Insurance, Liability & Indemnification
10.1 Insurance. 6th Note maintains general liability insurance and can furnish a COI upon request (lead time may be required).
10.2 Liability Limitation. To the fullest extent permitted by law, 6th Note’s liability is limited to the total amount paid by Client for the Event. We are not liable for indirect, incidental, or consequential damages, including lost profits or opportunities.
10.3 Indemnification. Client agrees to indemnify and hold harmless 6th Note, its owners, employees, and contractors from claims, damages, or expenses arising from (i) Client’s or guests’ negligence or misuse, (ii) venue conditions outside our control, or (iii) Client’s breach of this agreement.
11) Conduct, Compliance & Prohibited Items
11.1 Professional Conduct. We reserve the right to refuse or discontinue service if staff experience harassment, unsafe conditions, or illegal activity. No refunds in such cases.
11.2 Alcohol/Drugs. Illegal substances are prohibited at the station. Intoxicated individuals may be declined service for safety.
11.3 Compliance. Client ensures the Event complies with all applicable laws, permits, and venue rules.
12) Confidentiality & Data
12.1 Corporate/Private Formulas. If requested, we can provide enhanced confidentiality or sign a reasonable NDA for enterprise clients.
12.2 Guest Data. Any guest names/emails collected by us (e.g., for label printing) are used only to deliver the service or with explicit consent for marketing. Client agrees to comply with applicable privacy laws for data they provide to us.
13) Post-Event Issues & Corrections
13.1 Quality Concerns. Notify us in writing within 5 business days of the Event regarding any service concerns. We will review in good faith and propose a fair remedy if warranted.
13.2 Product Handling. Finished fragrance products should be stored away from heat/sunlight. Normal variations in fragrance maturation are expected; slight shifts in aroma over time are not defects.
14) Miscellaneous
14.1 Subcontracting. We may engage qualified assistants/subcontractors while remaining responsible for performance.
14.2 Severability. If any provision is unenforceable, the remaining terms remain in effect.
14.3 Entire Agreement. This, together with your signed proposal/invoice, constitutes the entire agreement and supersedes prior discussions.
14.4 Governing Law & Venue. Governed by the laws of Louisiana. Venue for disputes shall be in the parish of our principal business location, unless otherwise required by law.
14.5 Signature & Acceptance. Payment of the retainer and/or a signed agreement indicates full acceptance of these terms.
